Dismissal Language

Whereas it is critical that faculty members be notified at the earliest opportunity when allegations leading to dismissal have been laid against them; </DIV>

 

Be it resolved that</DIV>

Section 3-9 (D) "Preliminary Inquiry: of the USC Faculty Handbook be amended as follows:</DIV>

"When reason arises to consider whether cause exists to dismiss a faculty member who has tenure or whose term of appointment or contract has not expired, the relevant dean or academic director shall discuss the matter with him or her in a personal conference, looking to mutual settlement. At that conference, the dean or academic director shall also indicate the issues to be investigated and explain the formal procedures that might ensue to the faculty member. The dean or academic director shall also indicate whether an investigative committee will be assembled. Any consideration by the dean or academic director of dismissal shall be based on a thorough inquiry into the circumstances, and shall include consultation with a faculty committee, such as the school's elected Faculty Council or an ad hoc committee. The committee appointed shall include a faculty member from outside the school, drawn either from the Senate Committee on Faculty Rights and Responsibilities or the Commi</DIV>ttee on Faculty Tenure and Privileges Appeals. The faculty member under investigation will have the right to meet with the faculty committee. The Chair of the Senate Committee on Faculty Rights and Responsibilities is available for consultation and the Faculty Mediation Officer is available for mediation, but mediation is not mandatory. If the dean is satisfied that there is a probable cause for dismissal, he or she shall propose such action to the Provost."</DIV>
