Abstract: The city of Los Angeles became the epicenter of a public relations scandal on March 3, 1991, when an amateur cameraman captured on video four uniformed LAPD officers beating motorist Rodney G. King. In addition to generating public outrage, the incident cast a dark shadow over the LAPD and called into question the integrity of the nation's third largest municipal police force. Subsequently, the ten member Independent Commission on the Los Angeles Police Department was formed to conduct a full and fair evaluation of all aspects of the LAPD's structure and operations related to the use of force when making arrests. Included in this collection are the documents that were collected and analyzed by the Commission over the course of its study.

Historical note

On March 3, 1991, at the end of a high-speed vehicle pursuit, an amateur cameraman captured on video four uniformed LAPD officers beating motorist Rodney G. King. The incident, which occurred in the presence of a sergeant and a group of other officers, spurred public outcry and fostered an overwhelming sense of mistrust and disdain toward the LAPD. In response, the Mayor and the Chief of Police of Los Angeles each formed an independent citizens' commission to conduct a full and fair investigation into the LAPD's tactics, policies, practices, and procedures, especially those pertaining to the use of force when making arrests. To avoid overlap the two commissions subsequently merged and formed the Independent Commission on the Los Angeles Police Department, also referred to as the Christopher Commission.

Presiding over the ten member advisory body was Los Angeles attorney Warren Christopher, who had previously served in the Lyndon Johnson administration as Deputy Attorney General and in the Jimmy Carter administration as Deputy Secretary of State. Retired California Supreme Court Justice, John A. Arguelles, was selected to be second in command. Over the course of the investigation, Christopher, Arguelles, and the Commission members were assisted by an experienced staff of more than 60 attorneys from major Los Angeles law firms, all of whom worked strictly on a pro bono basis.

Together, the Commission and its staff reviewed one million pages of documentation related to "all aspects of the law enforcement structure in Los Angeles that might cause or contribute to the problem of excessive force." Special attention was drawn to the LAPD's training and recruitment practices, assignment and promotion procedures, internal disciplinary system, citizen's complaint process, and use-of-force guidelines. The investigation also centered on the role of the city's Board of Police Commissioners and evaluated the dynamics between the Mayor-appointed commissioners and members of the LAPD's administration.

The Commission concluded its study after three months and synthesized its findings into the "Report of the Independent Commission on the Los Angeles Police Department." The 228 page report identified several major structural problems within the LAPD that shed light onto the King incident and also offered conditions and recommendations for improvement. Many of the problems identified by the Commission were attributed to the LAPD's management and administration practices led by Chief of Police Daryl M. Gates.

The major issues and strategies identified in the Commission report can be grouped into the following thematic categories:

(1) Excessive Force. Dozens of officers abuse the Department's use-of-force guidelines by repeatedly exercising excessive force. These incidents are rarely included in the officers' personnel files.

(2) Racism. The problem of excessive force is aggravated by racism and bias within the LAPD. Officers brazenly send racist and sexist messages over the Department's Mobile Data Terminal (MDT) system without reprimand. A greater degree of sensitivity training should be incorporated into the academy curriculum to solve this problem.

(3) Community. The LAPD has an organizational culture that emphasizes crime control over crime prevention. This has fostered a "siege mentality" among officers and has isolated the police from the communities and the people that they serve. The Department should re-evaluate its philosophy and consider adopting a more proactive, community oriented approach to law enforcement.

(4) Discipline. The discipline system is skewed against citizens making complaints. Instead of conducting a full and fair evaluation, investigators seem more concerned with exonerating the accused officers of wrongdoing.

(5) Recruitment. The Department's current recruitment and screening program is a poor predictor of an applicant's tendencies toward violent behavior, and the background investigation pays too little attention to a candidate's history of violence. Officers should also be regularly screened to determine if physical or psychological problems develop over time.

(6) Chief. Chief of Police Daryl F. Gates should transition toward retirement, and his successors should be limited to two 5-year terms.

(7) Implementation. The support of politicians, the police, and the general public is essential to successfully enact reforms and implement change within the Department.

The Commission completed its study in 100 days and published its report in July, 1991, three months after the investigation was formally launched.

Scope and Content

Chaired by prominent attorney and former Deputy Secretary of State Warren Christopher, the Independent Commission on the Los Angeles Police Department assessed the structure and operations of the LAPD in connection with the Rodney King incident of March, 1991. The collection consists of materials collected and analyzed by the Commission and its professional staff over the course of their 100 day study. Materials reflect the major themes of the Commission's investigation including use-of-force guidelines, bias and discrimination, personnel and hiring practices, internal discipline, complaints, and citizen oversight.

Included in the collection are the following: excerpts from books, journals, dissertations, and reports related to the role of the police in society; newspaper and article clippings; excerpts from and analyses of the Los Angeles City Charter; court transcripts, memoranda, and legal briefs; correspondence with witnesses, LAPD personnel, and members of the general public; interview transcripts and copies of witness testimony; statistics related to the use of force maintained in LAPD databases; summaries of and excerpts from selected LAPD personnel files; settlement agreements between the city of Los Angeles and aggrieved citizens; street maps delineating the LAPD's service areas; and draft copies of several chapters from the Commission report. Also featured are materials related to the Commission staff's work product, including work plans, meeting agendas, notes, and correspondence.

Scope and Content

Included in the series are research materials collected by the staff of First Interstate Bancorp during their broad analysis of municipal police departments' structure and function. The series consists primarily of excerpts from books, reports, academic journals, case studies, and other published sources regarding the proper role of police in society. Series 3: Hufstedler, Kaus & Ettinger

Scope and Content

Included in the series are source materials that were collected and analyzed by Hufstedler, Kaus & Ettinger. The series consists of the following: notes, memoranda and reports from meetings held with religious leaders and community organizations; an informational packet describing the city of Los Angeles' employee Wellness Program, which was launched in 1985; a photocopy of the indictment of Lawrence Powell, Timothy Wind, Theodore Briseno, and Stacey Koon, the four LAPD officers involved in the Rodney King incident; essays and reports about police violence and civil disorder; and a packet of materials related to the San Pedro/Wilmington Skills Center, an occupational outreach organization in South Los Angeles. Bryan, Cave, McPheeters & McRoberts investigated the attitudes held by members of Los Angeles' African-American community toward the police, an issue that garnered national attention after the Rodney King incident. The series contains summaries of two interviews conducted with prominent figures within Los Angeles' African-American community, focusing primarily on police brutality in South Los Angeles and the fear that it instills among community members. Also included is a report pertaining to the professional and psychological history of Robert Brodowy, an LAPD officer who had amassed a personnel complaint history "unparalleled in the history of the Department."

Series 12: First Interstate Bancorp

Scope and Content

On April 3, 1991, the Los Angeles Board of Police Commissioners ordered Chief of Police Daryl Gates to take 60 days of paid administrative leave in response to the Rodney King incident. After threatening legal action, Gates was reinstated to his post as Chief by the City Council. However, this incident called into question the balance of power between the Chief of Police and members of the Commission. First Interstate Bancorp was the firm selected to investigate the dynamics between these two administrative bodies, and materials in the series pertain to the firm's work product.

Included are performance-related self evaluations submitted by Chief Gates to the Police Commission; the writ of mandamus petitioned by Gates related to his administrative leave; a legal opinion discussing the role of the City Attorney in cases where the opinions of two city bodies are juxtaposed; interview transcripts regarding the LAPD's procedures for handling complaints; memoranda about corruption within the LAPD; and reviews and summaries of literature regarding civilian oversight of municipal police departments. Series 13: Freeman & Mills

Scope and Content

To ascertain misconduct on the part of LAPD officers, the Independent Commission set out to probe databases maintained by the LAPD related to four areas: personnel complaints, use of force, officer-involved shootings (OIS), and the use of dogs (K-9). This task was delegated to the firm Freeman & Mills, which was responsible for obtaining these databases from the LAPD, converting pertinent data into useable formats, creating additional databases of additional information, and analyzing its findings. The series contains items related to Freeman & Mills' work product, including numerous analyses of use-of-force, OIS, and K-9 data; weekly complaint summary printouts; graphs, charts, tables, and other visual representations of this data; and computer directory lists that provide the names and locations of files within the LAPD's databases. At the end of the series is a draft copy of the Independent Commission's final report, which incorporates many of the aforementioned data and figures.

Series 15: Graham & James

Scope and Content

Graham & James researched two issues: the role of gender in the use of excessive force, and instances of gender discrimination within the LAPD. Research toward this end was derived from a wide variety of sources, including published literature, theses and dissertations, studies and statistics, police ride-alongs, and personal interviews. The series includes a memorandum issued by Graham & James discussing the reasons why female officers are less inclined to use excessive force, as well as many of the firm's interview notes.

Series 16: Heller, Ehrman, White & McAuliffe

Scope and Content

A critical component of the Commission's investigation centered on the idea that governance of the LAPD was shared between the Office of the Chief of Police, an administrative body, and the Board of Police Commissioners, a citizen body. To better understand the dynamic between these two entities, the staff of Heller, Ehrman, White, & McAuliffe researched the history of the Los Angeles City Charter, focusing primarily on its provisions regarding the distribution of power and the structure and organization of the LAPD. Included in the series are reproductions of reports, dissertations, article clippings, excerpts from city documents, and charter amendments related to the charter's conception and development over time. The series also includes several summaries of expert witness interviews regarding the effectiveness of this structure.

Hufstedler, Kaus & Ettinger conducted interviews with several LAPD patrol officers who were present at the time of the Rodney King incident. Series 19: Irell and Manella

Scope and Content

The circumstances surrounding the beating of Rodney King led many to believe that the incident was racially motivated and reflected a spirit of bias and discrimination within the LAPD. Irell & Manella analyzed in depth the LAPD's recruitment, hiring, training, and promotion practices to determine if bias and intolerance were in fact pervasive issues within the Department. The series includes materials related to Irell and Manella's work product, including the firm’s correspondence; summaries of personnel files for potential recruits; records of the Leon Panduro case, in which a citizen was shot by a probationary officer; minutes from the LAPD Professional Advisory Committee maintained between 1983 and 1991; witness files, which consist of written testimony and supplemental materials; and notes, outlines, and drafts maintained over the course of Irell and Manella’s investigation.

Series 22: Latham & Watkins

Scope and Content

Latham & Watkins researched a total of 83 civil litigation cases brought against the LAPD pertaining to excessive force and/or improper tactics to ascertain whether the Rodney King incident was in fact the "aberration" that Chief Daryl Gates described. Included in the series are several materials related to the firm’s investigation and final work product. Specifically, the series contains source materials related to the 83 cases that were studied. Scope and Content

The staff of Manatt, Phelps & Phillips extended its support to the Independent Commission by undertaking the following tasks: preparing and reviewing the recruitment/testing and academy/training chapters of the Commission report; presenting witnesses to the Commission; interviewing over 20 LAPD personnel of different departmental ranks; interviewing city staff and medical personnel; attending meetings with the Police Protective League; reviewing the background files of LAPD officers; attending numerous roll call training sessions and public meetings; researching and drafting legal memoranda in reference to labor issues arisen within the report; conducting general background research for the Commission; and attending two ride-alongs with the LAPD. Materials in the series pertain to the firm’s work product, including interviews conducted with alleged victims of police brutality and with respected figures in the law enforcement field. Also contained in the series are statistics that show the passage rate of new recruits who took a mandated psychological evaluation upon employment. These statistics are compiled according to gender and race.
